Abstract
The exchange contract is the in-kind contract stipulated in the Iraqi Civil Code in Article 507 as part of its definition of the sale contract, but it has not been regulated by special legal texts despite its great importance as it is contracts that are related to the daily life, and the exchange relationship is a contract based on exchanging each other with others, and it takes special forms By it either a completed exchange contract , a dating exchange contract ,a contract or a disbursement in the liability or an electronic exchange contract, which was permitted by Sharia unanimously by the majority of Muslim jurists with the availability of its element represented by the exchange. This study will cover all aspects of this contract in order to reach an integrated legal organization specific to its form and its pillars, just like other contracts that have their integrated legal organization.
