الملخص
هذا البحث یناقش تجربة الولایات المتحدة فی المراجعة القضائیة او الرقابة على دستوریة القوانین. بما ان الدستور العراقی النافذ قد تأثر الى حد کبیر بالنموذج الدستوری الأمریکی بات من الضروری الاطلاع على الأسالیب المتنوعة من التجارب المقارنة ومنها طریقة السوابق القضائیة فی الولایات. ان للمراجعة القضائیة فی الولایات المتحدة اسس قویة وحیویة جدیرة بالبحث والتطبیق. لذا کان لابد للمشرع العراقی الاطلاع علیها عن قرب. سیعمد هذا البحث على مقارنة المنهاج الأمریکی للمراجعة القضائیة بالأسس الجدیدة للرقابة القضائیة على دستوریة القوانین التی نص علیها الدستور العراقی فی المادة 2. لقد انشأت المحکمة العلیا فی الولایات المتحدة اسالیب واسعة للمراجعة القضائیة والتی یمکن للمحکمة الاتحادیة العراق ان تطبقها، ولکن بطریقة محدودة بسبب الظروف المتباینة فی کلا البلدین. لنرى ذلک بوضوح، نحتاج إلى إلقاء نظرة فاحصة على جذور ونطاق المراجعة القضائیة فی الولایات المتحدة. وسنتعرف على ما إذا کان بإمکان المحکمة الاتحادیة فی العراق تطبیق اسالیب الولایات المتحدة فی المراجعة القضائیة.
